Welcome to Mailcat (“we,” “us,” or “Mailcat”). These Terms of Service (“Terms”) govern your access to our email sequence product—including recipient lists, sequence steps, enrollment, scheduled sending, and related sending setup (the “Service”). By using the Service, you agree to these Terms. Please also read our Privacy Policy and Cookie Policy.
If you accept these Terms on behalf of a business, you represent that you have authority to bind that entity.
The Service
Mailcat is a cloud tool for writing multi-step email sequences, enrolling recipients, and sending on a schedule with pause and stop controls. Features, usage limits (including daily send caps), and availability may change as we improve the product. We will use reasonable efforts to notify you before changes materially affect paid plans, when paid plans are offered.
Eligibility and accounts
You must be at least 18 (or the age of majority in your jurisdiction, whichever is higher) to use the Service. Provide accurate account information and keep it up to date. You are responsible for your credentials and all activity under your account. Contact us promptly if you believe your account is compromised.
Acceptable use and email compliance
Use the Service only for lawful purposes. You may not misuse the Service, probe or disrupt our systems, scrape data without permission, reverse-engineer the Service (except where law forbids this restriction), or access another customer’s data. You must not upload malicious content or use the Service to infringe others’ rights.
You are responsible for the recipient lists and email content you send, and for complying with laws that apply to your outreach—including anti-spam, marketing, and privacy rules (such as CAN-SPAM, CASL, GDPR where applicable). You must have a lawful basis to contact recipients and honor unsubscribe or stop requests. We may suspend sending or accounts that appear abusive or unlawful.
Sending domains and deliverability
Outbound sending may require domain verification and DNS records configured with our email provider. Until a domain is verified, related sequences may not send. Domain setup may be assisted manually during early access. Deliverability depends on many factors outside our full control (recipient filters, reputation, content).
Plans, billing, and early access
During early access the Service may be offered free or under temporary terms we communicate on the site. When paid plans launch, prices, billing cycles, and quotas will be shown at purchase. Fees are generally non-refundable except where required by law. Payments may be processed by third-party providers under their terms.
Your data and our rights
You retain ownership of the business and recipient data you submit. You grant us a limited license to host, process, and display that data to operate the Service, enforce these Terms, and keep the platform secure. We own the Service, software, branding, and improvements. Aggregated or de-identified usage statistics may be used to improve the product.
Termination, changes, and disclaimers
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, for security or legal reasons, or if required by law, and will use reasonable efforts to notify you when practical. After termination we may delete account data after a reasonable period, except where law requires retention (for example send history used for daily limits).
We may update these Terms by posting a new “Last updated” date; material changes will be communicated reasonably. The Service is provided “as is” to the extent permitted by law. We are not liable for indirect or consequential damages or loss of data. Our total liability for claims relating to the Service is limited to the fees you paid us in the six months before the claim, or one hundred U.S. dollars (USD 100), whichever is greater.
